("Ema," "we," "us," "our") respects the importance of the privacy of enterprise users of our software-as-a-service platform for generative workflow automation services (the "Services") that we make available through our web site (the "Site"). We have created this Privacy Statement ("Privacy Statement") to inform you about how we collect, use, share, and otherwise process information relating to individuals ("Personal Information"). This Privacy Statement is incorporated by reference into the Ema Subscription Terms (the "Terms").

By using or accessing in any way the Site and/or our Services available through the Site, or by transmitting information to us by email or other electronic means, you agree to this Privacy Statement. If you do not agree with the terms of this Privacy Statement, please do not use the Site or Services.

PERSONAL INFORMATION WE COLLECT AND USE

  • Personal Information You Provide -We collect and retain Personal Information about you (including your name, telephone number, and e-mail address) that you voluntarily provide, so that you can obtain the Services through the Site or for us to contact you regarding the Services.
  • Financial Payment Information -If you purchase any products or services from Ema through the Site, you will provide your financial payment information. Your financial payment information will not be disclosed to any third party except only as needed to process the transaction.
  • Evaluation and Feedback -During an evaluation, trial, or normal Site use, we may ask you to evaluate the Site or our Services. Completing this evaluation is at your discretion; if you do, your evaluation may be shared with relevant members of our team and service provider(s) who process statistical information. If you provide us with your own comments about our Services, we may use them in our marketing or on the Site only if you give us permission.

AUTOMATIC COLLECTION OF PERSONAL INFORMATION

  • Cookies -We may use cookies (small text files that are placed on your browser or device) to retain your preferences, facilitate login and access to the Services, and tailor content.     Note: Google Workspace APIs are not used to develop, improve, or train generalized AI or ML models.

  • Service Providers -We share information with third-party service providers that help us operate, provide, improve, analyze, integrate, customize, support, distribute, market our Services, or related infrastructure services (e.g., Amazon Web Services). These providers may assist with consulting, administration, support, or other technical services. We prefer to require such service providers to handle Personal Information in a manner consistent with this Privacy Statement, using it only as necessary to provide services to us.
  • Legal Requirements -We may disclose your Personal Information as required by law-for example, to comply with a subpoena or similar legal process-when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. We may also disclose Personal Information if Ema Unlimited, Inc. is involved in a merger, acquisition, or sale of all or a portion of its assets.

ANTI-SPAM POLICY

We monitor and prohibit the use of our product for sending unsolicited commercial emails in violation of applicable laws, as stated in our Terms of Service. We require all our customers to agree to the Terms of Service, and any violations may result in suspension or termination of access to the Ema product. Our team works closely with customers to ensure high-quality and targeted campaigns.

OPTING OUT

You have the right to opt out of certain uses and disclosures of your Personal Information. Where you have consented to our processing, you can withdraw that consent at any time. If you receive an unwanted email from us, you can unsubscribe using the link at the bottom. We will process your request within a reasonable time after receipt. We may still send you certain non-promotional communications about updates to our Terms or this Privacy Statement.
Do Not Track (DNT). We do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

CHILDREN

Our Site and Services are not directed at, nor do we knowingly collect Personal Information from, children under 16. If you learn that a child under 16 has provided us with Personal Information, please contact us at privacy@ema.co. We will take appropriate steps to delete such information.

  • No Selling of Personal Information.As a business potentially covered by the California Consumer Privacy Act (CCPA), we do not sell your Personal Information for monetary consideration. However, certain data sharing described above could be deemed a "sale" under the CCPA.
  • Categories of Personal Information & Retention. These are described in "PERSONAL INFORMATION WE COLLECT AND USE" and "PERSONAL INFORMATION RETENTION."
